Terms of Service

1. The Service

• Artists can create pages that hand out tracks ("download gates").
• Listeners can download a track after meeting the conditions set on the download gate, such as following the artist on SoundCloud.

2. Accounts

• Artists log in to the Service with their SoundCloud account.
• Artists are responsible for managing their own account.
• If you notice unauthorized use of your account, please contact us promptly.

3. Tracks and images you upload

• Only upload tracks and images that you have the right to distribute. For remixes and edits, this means only those whose original rights holders have allowed distribution.
• You keep the rights to the tracks and images you upload.
• You allow the operator to store, copy and transmit your tracks and images to the extent needed to publish your download gates.

4. Reporting infringement

• If you find a track or image that infringes your rights, please tell us by email (support@downdraft.app).
• The operator will review the report and, if needed, stop publishing the download gate or delete the file.

5. Prohibited conduct

You must not:

• upload tracks or images that you do not have the right to distribute
• distribute malware or other files that harm users
• break the law or act against public order and morals
• break the terms of services the Service connects to, such as SoundCloud and X
• interfere with the operation of the Service or access it without authorization
• impersonate another person

6. Follow verification

• For SoundCloud follows, the listener logs in to SoundCloud and the Service follows the artist from the listener's account. The login is used only for this follow and is not stored.
• The follow is a normal SoundCloud follow. Listeners can unfollow on SoundCloud at any time.
• The Service allows a download only when it can verify the follow. If a connected service changes or stops in a way that makes verification impossible, download gates with that condition stop being published.

7. Fees and payment

• The Service has a free plan and a paid Pro plan. Prices and plan details are shown in the Service.
• The Pro plan renews automatically for the period you choose (monthly or yearly). Payment, cancellation and refund conditions are set out in the Legal Notice.
• If the Pro plan ends and you return to the free plan, download gates over the free plan limit stop being published, starting with the newest. Download gates and files are not deleted.
• We will announce any price change in the Service or by email at least 30 days in advance.

8. Deleting your account

• Artists can request account deletion from the dashboard at any time. Your download gates stop being published when you make the request.
• 30 days after the request, we delete your account, download gates and uploaded files. Logging in again before then cancels the deletion.

9. Suspension

If an artist breaks these terms, the operator may stop publishing their download gates or suspend their account without prior notice.

10. Changes to and ending of the Service

• The operator may change the Service.
• If the Service is shut down, we will announce it at least 30 days in advance and provide a period during which you can download your uploaded files.
• The source code of the Service is published as open source (AGPL-3.0). Anyone can run the same service even after this one ends.

11. Disclaimer

• The Service is provided as is. We do not guarantee any increase in downloads or followers.
• The operator is not responsible for damage caused by outages or changes in connected services.
• We will refund any fees charged by mistake because of a defect in the Service.
• For any other damage, the operator's liability is limited to 1,200 yen. This limit does not apply in cases of intent or gross negligence by the operator.

12. Changes to these terms

If we change these terms, we will announce the changes and the date they take effect in the Service in advance. For important changes, we will ask for your agreement again.

13. Governing law and jurisdiction

These terms are governed by the laws of Japan. The district court with jurisdiction over the operator's location has exclusive jurisdiction in the first instance over any dispute about the Service.
